Terms and Conditions of Sale

These Terms and Conditions of Sale (the "T&Cs") govern the sale of products by Black Girl Vitamins LLC, hereinafter referred to as "Seller," through its website, tryblackgirlvitamins.com (the "Website"). By placing an order on the Website, the buyer ("Buyer") agrees to be bound by these T&Cs. Please read these T&Cs carefully before using the Website.

1. Definitions

• "Seller" refers to Black Girl Vitamins LLC.
• "Buyer" means the individual or entity purchasing products from the Seller.
• "Products" refers to the items available for sale on the Website.
• "Order" means any request by Buyer to purchase Products from the Seller.

2. Orders and Acceptance

All Orders placed by Buyer are subject to acceptance by Seller. Seller reserves the right to accept or decline any Order for any reason, including but not limited to the unavailability of Products or errors in the price or description of the Products. Confirmation of an Order does not signify acceptance of the Order by Seller.

3. Pricing and Payment

All prices are listed in United States Dollars and are subject to change without notice. Payment for Products shall be made at the time of Order placement. Seller accepts payment via major credit cards and other payment methods as indicated on the Website. Buyer is responsible for any state or local sales taxes applicable to the purchase.

4. Delivery

Seller will deliver Products to the address provided by Buyer within the United States. Delivery will occur within 5 to 9 business days after Order processing. Seller is not responsible for delivery delays due to unforeseen circumstances beyond Seller’s control. Buyer is responsible for providing accurate delivery information; Seller shall not be liable for any loss or delay resulting from incorrect delivery details.

5. Returns and Refunds

Products may be returned within 14 days of receipt for a full refund, provided they are in original condition and packaging. To initiate a return, Buyer must contact Seller's customer support at help@thesupport.io. Buyer is responsible for return shipping costs unless the return is due to an error by Seller.

6. Limitation of Liability

To the maximum extent permitted by law, Seller’s liability for any claim arising out of these T&Cs or the sale of Products shall not exceed the purchase price of the Products. In no event shall Seller be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits or revenue, even if Seller has been advised of the possibility of such damages.

7. Force Majeure

Seller shall not be liable for any failure to perform its obligations under these T&Cs if such failure is due to an event beyond Seller’s reasonable control, including but not limited to acts of God, war, terrorism, strikes, or other labor disputes, fire, flood, or other natural disasters, or governmental acts.

8. Governing Law

These T&Cs shall be governed by and construed in accordance with the laws of the State of Massachusetts, United States, without regard to its conflict of law principles.

9. Dispute Resolution

Any dispute arising out of or relating to these T&Cs or the sale of Products shall be resolved through binding arbitration in Boston, Massachusetts, in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

10. User Obligations

Buyer agrees to comply with all applicable laws and regulations when using the Website and purchasing Products. Buyer shall not use the Website for any unlawful or prohibited purpose. Buyer shall not interfere with the operation of the Website or violate the security of the Website.

12. Amendments

Seller reserves the right to amend these T&Cs at any time. Any changes will be effective upon posting on the Website. Buyer’s continued use of the Website or purchase of Products after such changes are posted will constitute acceptance of the amended T&Cs.

13. Severability

If any provision of these T&Cs is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely matches the intent of the original provision.

14. Entire Agreement

These T&Cs, together with any Order confirmation or invoice provided by Seller, constitute the entire agreement between Buyer and Seller regarding the purchase of Products and supersede all prior agreements, understandings, and representations, whether oral or written.
